Acceptable Use Policy & Terms of Service

⚠️ Pending attorney review. Counsel is engaged (Fourscore Business Law, item 3). These Terms are in effect as written and will be updated on their review — particularly the liability cap (§6), governing law and venue (§10), and the user-generated-content provisions (§2, §7).
By generating an API key, calling the API, or otherwise using the Service, you ("you," "Customer") agree to these Terms and the Acceptable Use Policy below. If you use the Service on behalf of an organization, you represent that you have authority to bind it.
1. The Service
The Service is an API that renders images from inputs you supply (text, template selections, and URLs to images or logos). You are responsible for obtaining and keeping your API key confidential. All activity under your key is your responsibility. We may issue, rate-limit, rotate, or revoke keys at any time.
2. Acceptable Use Policy
You are solely responsible for all inputs you submit and all outputs you generate. You agree not to use the Service to create, request, store, or transmit any content or to engage in any conduct described below.
2.1 Prohibited content
- Child sexual abuse material (CSAM) or any content that sexualizes, exploits, or endangers minors. This is prohibited without exception and will be reported to the appropriate authorities, including the National Center for Missing & Exploited Children (NCMEC), as required by law.
- Content that infringes any copyright, trademark, trade secret, publicity, privacy, or other intellectual-property or personal right.
- Content that impersonates a real person or entity, or that is designed to deceive, defraud, or mislead (including deepfakes intended to harm, disinformation, or fake credentials/documents).
- Content that promotes or depicts violence, terrorism, or self-harm, or that harasses, threatens, defames, or incites hatred or discrimination against any individual or group.
- Sexually explicit or pornographic content.
- Malware, phishing pages, or imagery created to facilitate a scam, fraud, or security compromise.
- Content that violates any applicable law or regulation, including export-control and sanctions laws.
2.2 Prohibited conduct
- Attempting to access, probe, or disrupt the Service, other customers, or our infrastructure — including SSRF, injection, or any unauthorized security testing without our prior written consent.
- Circumventing or attempting to circumvent authentication, rate limits, quotas, or usage metering.
- Reselling, sublicensing, or redistributing the Service except as expressly permitted by your plan, or using the Service to build or train a competing product.
- Reverse engineering, scraping, or automated bulk extraction beyond documented API use.
- Using the Service in any application where failure could lead to death, personal injury, or severe physical or environmental damage (high-risk uses).
3. Enforcement
We may investigate suspected violations and may suspend or terminate your access, revoke your key, and remove content immediately and without notice if we believe, in our sole discretion, that you have violated this Policy or created risk or legal exposure for us or others. No refund is owed for access terminated due to a violation. We may preserve and disclose information where required by law or to protect our rights, users, or the public.
3.1 Repeat infringers
We maintain and enforce a policy of terminating, in appropriate circumstances, the accounts and API keys of users who repeatedly infringe the intellectual-property rights of others.
- We record every infringement notice we receive, the account it concerns, and the action we took.
- An account that is the subject of repeated valid notices will have its key revoked and its access terminated. What counts as "repeated" is judged case by case — the seriousness of the notices, whether they were contested, and whether the user removed the content.
- Termination for repeat infringement is not a refundable event (§3).
- If you believe a notice was mistaken, write to us at the address in §8 and we will handle it under the DMCA counter-notification process.
- Images removed under this section are the Acceptable Use Policy exception described in §4.1.
4. Your content and license
You retain ownership of your inputs and, subject to these Terms, the outputs you generate. You grant us a limited license to store, process, and serve your inputs and generated images solely to operate and provide the Service. We do not claim ownership of your content and do not use it to develop competing products.
4.1 Image permanence
Generated image URLs are permanent. Because generated images are referenced from og:image and similar tags on pages and posts you do not control, we serve them indefinitely and do not delete them when your plan changes.
- Plan quotas limit the creation of new images. They never limit the serving of images already generated.
- If your subscription lapses, is cancelled, or is downgraded, images generated before that date continue to be served at their existing URLs. You lose the ability to generate new images — not the images you already have.
- Exception: we may remove images that violate the Acceptable Use Policy (§2), or where we are required to do so by law.
5. Availability; no warranty
The Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uptime, accuracy, or that the Service will be uninterrupted or error-free. You are responsible for validating outputs before relying on them.
6. Limitation of liability
To the maximum extent permitted by law:
- We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business interruption, arising out of or relating to the Service, even if advised of the possibility.
- Our total aggregate liability for any and all claims relating to the Service will not exceed the greater of (a) the total fees you paid to us in the three (3) months immediately preceding the event giving rise to the claim, or (b) USD $100.
These limitations apply regardless of the theory of liability and are a fundamental basis of the bargain between us.
7. Indemnification
You will defend, indemnify, and hold harmless El Triangulo Studio LLC and its owner from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your inputs or outputs; (b) your use of the Service; or (c) your violation of these Terms, the Acceptable Use Policy, or any law or third-party right.
8. Copyright / abuse reports
To report infringing content or abuse, contact create@eltriangulostudio.com with a description of the content, the offending request or output, and your contact information. We respond to valid notices and, where applicable, follow the notice-and-takedown process under the DMCA.
9. Changes
We may modify the Service or these Terms. Material changes take effect when we post the updated version with a new effective date (or as otherwise required by law). Continued use after changes means you accept them.
10. Governing law
These Terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Johnston County, North Carolina.
